Webinar: Avoiding the Crisis – Ethical Pitfalls and Security Breaches

June 28, 2016

An occurrence of ethical misconduct or a security breach is a crisis for any organization. Financial institutions are under increasing pressure to investigate and self-report allegations of wrongdoing, and internal investigations are becoming more frequent. Our presentation will review the changing landscape of attorney-client privilege in internal investigations and provide an update on developments in the area of cybersecurity.

We will cover recent court decisions, best practices and ways a company can best protect the attorney-client privilege in internal investigations. We will highlight key considerations to be made at the outset of any investigation, common pitfalls that can result in the disclosure of privileged information, and best practices for interviewing witnesses and presenting the results of the investigation to a variety of audiences.

With respect to cybersecurity, we will discuss related regulatory requirements, how to investigate and mitigate an attack, and how to prepare to defend inevitable post-attack litigation.

The presentation will be interactive and will include hypothetical situations that illustrate common problems that arise when conducting internal investigations and dealing with cybersecurity issues.
