These attorneys were peer-nominated and selected by a panel of seasoned legal and law enforcement experts for their demonstration of exceptional legal knowledge, ethical standards, and professional accomplishments.

Bret Evans is a member of the firm’s commercial litigation and bankruptcy practice groups. His practice is concentrated primarily in complex commercial litigation, bankruptcy, foreclosure and creditor’s rights. He has represented creditors and banks in fraud cases, replevin actions, receivership actions, and other claims. Evans has also assisted financial institutions with matters related to consumer financial services, including cases involving claims of wrongful foreclosure, alleged violations of the Truth in Lending Act (TILA), and lien disputes.

Liz McOmber’s practice is concentrated in product liability defense litigation and complex commercial litigation, where she defends high-stakes product defect claims against leading manufacturers of automobiles, commercial vehicles and component parts, watercraft and marine products, aircraft, pharmaceuticals, medical devices and asbestos containing products. Her complex commercial litigation experience includes advising and defending insurance carriers on coverage issues and in claims for breach of contract and bad faith, defending companies in Limitation of Liability Act proceedings and defending construction defect cases.

Rachael Motzkus is a real estate attorney focusing on commercial development, office and retail leasing, acquisitions and dispositions of real property, title insurance, entitlements and land use issues, real estate financing, and partnerships and joint ventures. She assists a wide variety of clients ranging from landowners, developers, and tenants to real estate investment trusts (REITs) and asset management firms. Motzkus handles clean energy real estate projects including solar and wind land acquisition and development. She also assists homebuilders and other multi-use commercial developers in all stages of acquiring and developing real property.

Jeremy Stewart concentrates his practice in commercial litigation. Stewart has extensive experience representing clients before state and federal courts, in local and international arbitrations, in mediations and before numerous regulatory agencies.

Ben Welch is member of the firm’s commercial litigation practice group. He began his career as a criminal prosecutor and worked on both sides of the criminal bar. After trying felony cases before Utah juries, he transitioned to a civil practice where he now applies those same skills in high-conflict commercial litigation. Although his practice is diverse, Welch has a particular interest in litigation involving land use rights, real estate, and commercial leasing.
