Charlene Warner’s practice is concentrated on political litigation and government regulatory compliance. She represents government entities, businesses, and individuals in a variety of litigation and administrative matters.
Charlene focuses her practice on political and election law, government relations, and commercial litigation. Her litigation experience includes representing clients on various state and federal Constitutional law issues at both the trial and appellate court levels, including free speech and religious liberty under the First Amendment and the Religious Land Use and Institutionalized Persons Act (RLUIPA), the separation of powers and non-delegation doctrines, the Gift Clause, and the federal Voting Rights Act. Moreover, Charlene has litigated several challenges to candidate nomination petitions and ballot initiatives covering a variety of topics. She also frequently represents members of the firearm industry in civil litigation involving the intersection between political and commercial speech, the Second Amendment, and the Protection of Lawful Commerce in Arms Act (PLCAA).
Charlene’s administrative law practice includes policy development, regulatory compliance, and administrative appeals. She has significant experience with litigating and providing compliance advice regarding state and federal affordable housing programs, including the Low Income Housing Tax Credit (LIHTC) Program, Section 515 Rural Rental Housing Loans, and Section 8 of the Housing Act of 1937. She also handles compliance-related matters involving the Federal Aviation Administration (FAA), and frequently advises agencies, political candidates, and businesses about issues related to Freedom of Information Act (FOIA) and state public records requests, campaign finance, lobbying, public finance, and Environmental, Social, and Corporate Governance (ESG).
