Biography

Cole Tipton is a commercial litigator that excels in representing clients facing complex civil litigation matters. He has extensive experience in intellectual property disputes, including before the International Trade Commission (ITC), U.S. Patent and Trademark Office Patent Trial and Appeals Board (PTAB), and in Federal Courts. Cole provides comprehensive legal support in high-stakes cases and is adept at managing multi-patent cases through trial. He has a proven track record in pre-trial planning, drafting and arguing motions, taking and defending depositions, and working closely with experts to build strong, evidence-based cases.

Cole’s experience in ITC Section 337 proceedings is substantial. During law school, he clerked for Chief ALJ Bullock at the International Trade Commission. As a practicing attorney, Cole has assisted clients through multiple ITC investigations and has been involved from pre-complaint investigations through the enforcement phase. Cole is well suited to advise clients through the nuanced issues that come up during ITC investigations, and to handle the fast-paced timeline to a hearing.

As a trained engineer, Cole is prepared to explain complex technologies to the Court and jury. Coming from a family of farmers, Cole brings a down to earth, get the job done mentality that allows him to excel in fast-paced litigation. Cole’s agricultural background has also allowed him to represent manufacturers and innovators in various agricultural machinery related matters, which he considers passion projects.

Representative Experience

  • Represented global manufacturer of agricultural and industrial equipment as plaintiff in a patent infringement litigation against two competitor-defendants. Took deposition of key engineer that was instrumental to telling a story of copying at trial. Litigated case to a jury verdict following a two-week trial.
  • Represented innovating manufacturer of fluid application equipment in defending against a patent infringement claim. Took key depositions during discovery that supported antitrust counterclaims against serial monopolist.
  • Assisted global manufacturer of fitness and wellness equipment in an enforcement proceeding relating to video streaming technology at the International Trade Commission. Developed critical technical theories to advance client’s position and prepared and defended witnesses for deposition.
  • Represented a global manufacturer of RFID tolling technology in a patent infringement case at the International Trade Commission against its U.S. based competitor in connection with a dispute over tolling technologies. Served a significant role in investigating, developing, and presenting the technical case over the course of an expedited litigation with a target date of less than ten months from institution to completion of the evidentiary hearing.
  • Represented global manufacturer of cellular communications equipment in connection with a global patent dispute over critical wireless technologies in the Eastern District of Texas. Assisted with litigation of claims and defenses regarding fair, reasonable and non-discriminatory (FRAND) terms for cross-license patent agreements.
  • Represented global technology manufacturer in connection with patent dispute relating to memory chips. Developed key non-infringement and invalidity arguments, and drafted and managed IPRs.
  • Represented aerospace manufacturer in trade secret dispute. Led investigation into misappropriation accusations.
