Biography

Kevin Walton represents clients spanning a broad range of industries, including oil and gas companies, financial institutions, secured and unsecured creditors, general contractors and other construction professionals. He focuses his practice in complex commercial litigation, including class action lawsuits and real estate litigation. He also represents court-appointed receivers throughout the United States. In addition, Kevin practices in the creditors’ rights area and has experience representing financial institutions, secured and unsecured creditors, and equipment lessors in workouts, bankruptcy, litigation and the recovery of collateral. He has represented clients in state and federal courts throughout Colorado and Wyoming in complex commercial disputes and has defended businesses against putative class actions. Having clerked in the United States District Court for the District of Wyoming and the Tenth Circuit Court of Appeals, Kevin provides valuable insight in all aspects of litigation, including alternative dispute resolution, trials, and appeals.

  • Represent pharmaceutical company in dispute, including claims for breach of contract, fraud, and breach of fiduciary duties
  • Represent large global information company in breach of contract suit involving creation of new operating software
  • Represent judgment creditor in suits to set aside fraudulent transfers and to pierce corporate veil of judgment debtor
  • Represent secured creditors in efforts to execute on judgments, including, obtaining, and enforcing writs of execution for real and personal property, garnishment proceedings, and setting aside fraudulent transfers
