Biography

Timothy E. Reilly is an experienced attorney who specializes in construction law and risk management. With a background in insurance, construction management and real estate development, Tim offers practical legal guidance to clients across various industries, from project owners to contractors.

Tim drafts and negotiates construction agreements, including AIA, DBIA, and custom forms, and has significant experience with design-build projects and public-private partnerships. He also advises on a wide range of agreements, such as subcontracts, joint ventures, supply agreements, leases, and financing documents.

In addition to transactional work, Tim helps clients navigate construction-related disputes, including delays, change orders, mechanic’s liens, and warranty claims. He has led and managed numerous contested matters, guiding clients through the entire process from discovery to settlement or trial.
Tim’s approach is grounded in a deep understanding of the construction process, which allows him to deliver efficient, practical solutions that keep projects on track and clients protected.

Representative Experience

  • Represented a construction manager in drafting and negotiating the contract and covenants, conditions and restrictions for a 42-unit $130 million luxury condominium project.
  • Assisted a contractor in negotiating the contract for a $400 million urban redevelopment project, transforming the site into a mixed-use development with housing, office space, retail, and parking.
  • Represented a general contractor in a public-private partnership for a municipal energy district, including drafting and negotiating the construction contract, as well as related developer, corporate formation, and framework agreements.
  • Served as lead counsel in drafting and negotiating contracts for the construction of a $110 million university commons and residential housing development.
  • Acted as lead counsel in negotiating the contract for a $200 million state university residential project.
  • Represented a contractor in negotiating the contract for the $100+ million redevelopment of infrastructure and public amenities at a mountain ski resort.
  • Drafted and negotiated prime agreement on behalf of a general contractor for an $85 million historic infill development including luxury apartments, parking and commercial units.
  • Served as lead counsel in negotiating the contract for the construction of a $100+ million infrastructure and senior living complex.
  • Led negotiations for construction contracts for contractors, construction managers, and design-builders across numerous commercial projects ranging from $25 million to $100 million.
  • Assisted general contractors with revision and overhauling of their standard construction templates, including design-build agreements, joint venture agreements, purchase orders, design services agreements, and subcontracts.
  • Managed local transactional and litigation matters for a national construction company.
  • Supervised transactional and lease disputes for a national mixed-use developer.
  • Provided advisory services on pending legislative and regulatory matters to ensure compliance.
