Legal Alert: Antitrust Update

Terminating dealers and franchisees is often fraught with legal and litigation risks. Many of these risks can be addressed up front with thoughtful planning. The Seventh Circuit – via Judge Posner – recently addressed some of these risks and suggested a road-map for the applicability of First Amendment to statutes protecting dealers and franchisees in Girl Scouts of Manitou Council, Inc. v. Girl Scouts of the U.S., Inc., ___ F.3d ___, 2011 WL 2119752 (7th Cir. 2011). While not an antitrust case, the Girl Scouts decision addressed issues that frequently arise in such cases.
