Legal Alert – Impacts of Court Ruling on Assured and Adequate Water Supplies

On June 6, 2014, the Maricopa County Superior Court vacated an Order of the Director of the Arizona Department of Water Resources (Order). If the Superior Court’s decision is ultimately upheld, it could create uncertainty in a developer’s ability to demonstrate an assured or adequate water supply. The decision could also create uncertainty in other water regulatory programs in addition to the assured and adequate water supply program, which could impact supplies inside, and, as in this case, outside, of an Active Management Area.
