Welcome to the fall edition of our Under Construction newsletter. As predicted, COVID-19 still plays a significant role in how we do business in 2020. In this issue, we take a look at how the coronavirus pandemic has continued to disrupt the construction industry.

We start with an article examining COVID-19’s influence on OSHA guidance as it pertains to the construction workforce. It answers questions about COVID-19 diagnosis reporting and compares it to other work-related incidents.

The next article also touches on COVID-19. As the pandemic continues, businesses are constantly learning how to legally comply with various mandates and if they can be held liable for COVID-19 exposure to their employees. Utah has mandated a new statute that could be followed by other states.

We then turn to how the duty of good faith and fair dealing has been affected by the pandemic, and the laws surrounding terminations for convenience in Arizona and beyond.
